چکیده
خداوند بی همتا در کلام نورانی خود، نعمت بیان و سخن گفتن را به عنوان یکی از بزرگترین نعم الهی مطرح نموده و آن را به نحو شایانی مورد ستایش قرار می دهد. و به زیبایی در این باره می فرماید: (الرحمن عَلَّمَ الْقُرْآنَ خَلَقَ الْإِنسَانَ عَلَّمَهُ الْبَیَانَ )2؛ خداوند رحمان قرآن را یاد داد. انسان را آفریده به او بیان و گفتن را آموخت.
این تعریف و تمجید از ناحیه ی حضرت حق، بدین جهت است که با نعمت ارزشمند بیان است که آدمی می تواند بسیاری از معارف و حقایق دینی و دستورات الهی را دریافت و به دیگران منتقل سازد، تا همگان از دریای خروشان معارف الهی بهره مند گشته و با به کار بستن آنها، به سعادت ابدی دست یابند.
با وجود اینکه نعمت ارزشمند بیان، از مهمترین و کارآمدترین نعم الهی است اما باید توجه داشت که این نمت گرانسنگ، می تواند بسیار خطرناک و گمراه کننده هم باشد، به گونه ای که سرنوشت آدمی را تاریک و ظلمانی و او را در پیشگاه الهی شرمسار و روسیه نماید.
هشتمین اختر تابناک آسمان ولایت، حضرت علی بن موسی الرضا (علیه السلام) می فرماید: (ان الصمت باب من ابواب الحکمة، ان الصمت یکسب المحبة انه دلیل علی کل خیر)9 سکوت دری از درهای حکمت است، همانا سکوت محبت می آورد و راهنمای تمام خیرات است.
فرمایش نورانی امام رضا (علیه السلام) بیانگر این مطلب است که اگر انسانی که می خواهد به سخنان حکیمانه دست یابد و همواره سخنان ارزشمند و کارآمد به زبان آورد باید حتی المقدور از پرحرفی پرهیز نماید و افزون بر این، اگر می خواهد علاقه و محبت مردم را به سوی خود جلب نماید به گونه ای که از عمق جان او را دوست داشته باشند، و دوستی ها را حفظ کند باید از سخنان بیهوده و پرحرفی پرهیز نماید، و دلیل این امر هم کاملاً روشن و واضح است زیرا اولاً: بسیاری از کدورت ها و ناراحتی و دشمنی ها، به خاطر زخم زبان و سخنان ناشایست است که انسان آنها را به زبان آورده و باعث رنجش خاطر افراد می شود، بنابرابن اگر زبان خود را کنترل نموده و از سخنان ناشایست و بیهوده پرهیز نماییم، به یقین محبت و الفت را در زندگی برای خود به ارمغان خواهیم آورد. ثانیاً: کسی که زیاد حرف می زند همنشینی با آنها، اطرافیان را خسته و ملول ساخته و از همکلامی با او، احساس رنجش و ناراحتی می کنند و لذا طبیعی است که همواره از او فاصله بگیرند و محیت و علاقه آنها به او کم شود.

روابط قوا در جمهورى اسلامى ایران
روابط قوا در جمهورى اسلامى ایران برخلاف تمامى کشورهاى دنیا به گونه اى خاص تنظیم شده است. هر چند که به ظاهر به صورت تفکیک نسبى قوا تلقى مى شود، لیکن این روابط از ویژگى هاى خاصى برخوردار است که به خوبى آن را از سایر رژیم ها متمایز مى سازد.(4)
مفهوم تفکیک قوا در مقابل «وحدت قوا»(5) به کار مى رود. این تفکیک موجب پدیدارى سازمان هاى حاکم عدیده تخصصى مى گردد که هر کدام به انجام وظیفه خاص خود مشغول اند و هیچ یک از قوا حق انجام وظیفه قواى دیگر را ندارد. سنخیت قواى حاکم، هم چنین اقتضا مى کند که هر یک از قوا، بدون برترى و دخالت یکى در قلمرو اختیارات دیگرى، کار خود را انجام دهد و هیچ یک از قوا حق سؤال، استیضاح، عزل و انحلال یکدیگر را نداشته باشد. این چنین استقلالى را اصطلاحاً «تفکیک مطلق قوا»(6) مى گویند.
نظریه تفکیک مطلق قوا، در جریان تحولات تاریخى دست خوش تغییراتى شده است که دیگر نمى توان استقلال در مفهوم آن را چندان مشاهده کرد. خطر بالقوه و بالفعلى که از ناحیه قوه مجریه و زمام دارى آن ناشى مى شود، هم قواى دیگر را تحت الشعاع «ریاست گرایى»(7) اجرایى قرار مى دهد و هم این که آزادى و امنیت فردى را تهدید مى کند.(8) دلیل این مطلب این است که در اکثر کشورهاى دنیا در بحث ارتباط متقابل قوا، قوه مجریه مشمول بیش ترین نظارت ها از سوى دو قوه دیگر قرار مى گیرد.
قانون اساسى جمهورى اسلامى ایران، در تدوین قواى سه گانه، علاوه بر ضرورت همکارى قوا، براى تأمین اهداف کلى نظام از اندیشه مذکور به دور نبوده و مراتبى از ارتباط متقابل، توأم بانظارت و مسئولیت بین قواى حاکم را پیش بینى کرده است. در اصل 57 قانون اساسى ضمن برشمرن قواى سه گانه، مقرر مى دارد که این قوا مستقل از یکدیگرند. آن گاه در اصل 58 و 59 اِعمال قوه مقننه را منحصر به مصوبات مجلس شوراى اسلامى و در مسائل مهم از طریق همه پرسى و مراجعه مستقیم به آراى عمومى بیان داشته است. هم چنین در اصل 60 قانون اساسى، اِعمال قوه مجریه به استثناى برخى از آن که مستقیماً به عهده رهبرى قرار دارد، صرفاً از طریق رئیس جمهور و وزرا اجرا مى شود و در نهایت این که اِعمال قوه قضاییه (اصل 61) را نیز فقط به عهده دادگاه هاى دادگسترى قرار داده که باید براساس موازین اسلامى تشکیل و به حل و فصل دعاوى و ... بپردازد، اما نویسندگان قانون اساسى در سال 1358 در همان اصل 57 قانون اساسى، ضمن بیان استقلال قوا آورده بودند که : «... روابط بین قواى سه گانه توسط رئیس جمهور برقرار مى گردد.» و نیزدر اصل 113 قانون اساسى آمده بوده: «... مسئولیت اجراى قانون اساسى و تنظیم روابط قواى سه گانه و ریاست قوه مجریه جز در امورى که برعهده رهبرى است، به عهده رئیس جمهور است».
بنابراین، طبق این اصول، رئیس جمهور هماهنگ کننده قواى سه گانه کشور بود، لیکن پس از بازنگرى قانون اساسى در سال 1368 و با سپرى کردن یک دهه تجربه عملى در کارهاى اجرایى، قضایى و تقنینى وضعف هایى که در قانون اساسى وجود داشت، شوراى بازنگرى قانون اساسى به فرمان امام خمینى(ره) در تاریخ 1368/2/4 تشکیل گردید و در آن در خصوص روابط قوا نیز نکاتى مورد توجه و تصویب قرار گرفت.
در قانون اساسى 68 بعد از بازنگرى، ضمن این که مسئولیت تنظیم روابط بین قواى سه گانه را از رئیس جمهور گرفته و به شخص رهبر واگذار کرده است، در اصل 57 آمده است:
«... قوه مقننه، مجریه و قضاییه زیر نظر ولایت مطلقه امر و امامت امت برطبق اصول قانون اساسى اعمال مى گردند.» هم چنین در اصل 110 قانون اساسى، ضمن برشمردن وظایف و اختیارات رهبر، در بند 7 همین اصل یکى از وظایف رهبر را «حل اختلاف و تنظیم روابط قواى سه گانه» متذکر شده است و در اصل 113 نیز این مسئولیت را از رئیس جمهور سلب کرده است.
